Is online notarization actually legal in North Dakota?
Yes. North Dakota authorized Remote Online Notarization with SB 2128, effective August 1, 2020. The relevant statute is §§44-06.1-01 to 44-06.1-23. A document notarized online by a North Dakota-commissioned online notary has the same legal effect as an in-person notarization.
Do I need to be physically located in North Dakota?
No — you do not need to be in North Dakota. The notary must be physically located in North Dakota at the time of the act, but you (the signer) can be anywhere in the world. This is a defining feature of §44-06.1-13.
What kind of ID do I need?
A current government-issued photo ID: North Dakota driver's license or state ID, U.S. passport, or military ID. The statute requires "satisfactory evidence" of identity; we meet this through credential analysis (ID scan) plus knowledge-based authentication (KBA) pulled from public records.
Are there documents that cannot be notarized online in North Dakota?
