Background
South Dakota-commissioned notaries public are not currently authorized to perform remote online notarization. However, on March 18, 2021 the governor signed SB 193, which only allows the use of communication technology during a notarization if the notary “affixes the notarial officer’s signature to the original tangible documents” executed by the signer and only if the signer is personally known to the notary, as of July 1, 2021.
