How to Become a Traditional Notary in New Mexico
To become a New Mexico Notary Public, you need to complete the following:
- Sign up for an online notary education course that is recognized by the state and sit through the exam. It enables you to grasp exactly what you’re supposed to do.
- After engaging in the training, make sure to complete the notary public application form. Please note that the notary public you find will have to authenticate it by adding his/her signature and a stamp, so just don’t worry about it and let them do it.
- Among the requisites are the notary seal, a journal, and a surety bond costing $10,000. Once you have your bond, ensure the firm gives you a power of attorney that includes the name of the person who signed the bond.
- Now that you have everything, submit your completed application, along with the surety bond, power of attorney, certificate of course completion, and a $30 application fee, to the Secretary of State’s office.
- After you have been approved (usually within 45 days), you are required to mail in a Stamp Registration Form with which you can register your Notary seal.
- While not mandatory, it is nonetheless recommended to secure Errors and Omissions (E&O) insurance.
Once you’ve completed these steps and received your commission, congratulations! You’re officially a New Mexico Notary Public, ready to serve your community.

Is training required to become a New Mexico Notary Public?
In the majority of states (including New Mexico), you’ll have to graduate from a notary education class and pass it in order to become qualified. The Secretary of State might offer the course and exam themselves. They may also approve certain third-party providers to administer the training and test. (The BlueNotary Academy is one example!)
Just remember, you’ll need to score at least 80% on the exam to pass.
Who can I notarize documents for?
You can’t notarize your own documents or documents where you have a personal stake. Though it is not illegal to do it, the state suggests not doing the notarization for close relatives because it will draw suspicion about impartiality.
New Mexico Notary Public FAQs
What do I need to do if I move or change my name?
You might have moved to a different place or decided to use a different name; in either case, ensuring that your notary public information is up to date with the Secretary of State will be necessary. Here’s what you need to do:
If you move, the Secretary of State should know within 30 days. In addition, you must notify your surety by letter as well. However, it’s great that there’s no cost for the upgrade. There is no handier “Notary Public Change of Address” form which you can mail or fax to the Secretary of State’s office.
On a different note, if you wish to have a name change, write the “Notary Public Name Change Application” together with a bond company acknowledgment of your name change and an impression of your new seal of oath. There is a $3 transaction fee applied for that.
By keeping your information up-to-date, you’ll avoid any complications while performing notarizations.
How can I renew my Notary Public commission in New Mexico?
If your commission term ran out less than 12 months ago, you can purchase another $10,000 surety bond in addition to the renewal application form. If, on the other hand, your commission has been inactive for more than a year, you will need to take a refresher course, pass the exam again, purchase a new bond, and send the renewal application.
Is Online Notarization Legal in New Mexico?
New Mexico has enforced Online notarization since the 1st of January 2022 after the passing of Senate Bill 12. Besides a standard notary commission, online notaries have to take a RON training course and exam and acquire a separate online notary commission as well.
What to Expect as a Notary?
As in other professions, the amount of work an online notary receives can vary widely. Generally, the busiest time is tax season, when documents such as tax returns need to be signed and notarized. However, there is also a steady demand throughout the year from businesses and individuals in need of authentication services. There are many businesses that need consistent notarizations. Did we mention there are over 1.25 billion notarizations performed annually?
It is important to remember that when working as an online notary, you are responsible for adhering to the regulations set forth by the state. This includes making sure documents are properly notarized and witnessed. Always ensure documents contain all of the necessary information. The most successful online notaries spend some time doing their own client acquisition and sales funneling, especially those who are doing it online.
